Balcony Inspections

Newly repaired Balcony with Columns

California has passed State Bills SB 721 and SB 326. SB 721 involves mandatory balcony, deck and porch inspections for multi-family buildings where those exterior elevated elements are built using wood and at least 6 feet above ground. While initial inspections needed to be completed by January 1, 2025; regular inspections must be performed every 6 years. Inspections must be performed by a licensed Architect, Civil Engineer or Structural Engineer. While SB 721 generally applies to apartment buildings where the apartment units are rented out, SB 326 applies to condominium buildings with 3 or more units. With SB 326, Homeowners' Associations are required to schedule balcony, deck and porch inspections every 9 years for all exterior elevated elements that are at least 6 feet above ground. In both cases, failure to comply will result in fines and exposure to liability.
